DMCA / Copyright Policy

1. Commitment to Copyright Protection

We respect the intellectual property rights of creators and copyright owners. In compliance with the Digital Millennium Copyright Act ("DMCA"), Title 17, United States Code, Section 512, we respond expeditiously to notices of alleged copyright infringement resolved through our website SoundCloudDownloader.io.

2. Technical Intermediary Statement (Safe Harbor)

Please note that SoundCloudDownloader.io is a stateless, automated web utility. Our Service acts strictly as a transient conduit: we do not host, store, cache, archive, redistribute, or catalog any audio files on our servers.

When a user inputs a public SoundCloud URL, our serverless edge proxy (running on Cloudflare Workers) processes the metadata, generates a direct stream link from SoundCloud\'s API, and pipes the download data stream directly to the user\'s device. All data is processed on-demand in volatile memory and is instantly discarded upon transmission.

As such, we qualify as a Service Provider under the safe harbor provisions of DMCA 17 U.S.C. § 512(a) (Transitory Digital Network Communications). Because we do not store copyrighted content, we cannot physically delete files from our servers (since they are hosted on SoundCloud Limited). However, we are committed to blocking the resolution of specific URLs if they are reported to us as infringing.

4. Requirements for a Valid Takedown Notice

If you believe your copyrighted work is being resolved through our website without authorization, you must submit a written notification containing ALL of the following six elements (in accordance with 17 U.S.C. § 512(c)(3)):

  1. Copyrighted Work Identification: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Infringing Material Location: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  3. Exact URL(s): Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (you must provide the exact SoundCloud URLs or direct resolver pages on our site).
  4. Contact Info: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Failure to include all of the above information may render your DMCA notice invalid or delay our processing of the request.

5. Action Upon Receipt of Notice

Upon receipt of a valid, fully compliant DMCA notice, we will act promptly to disable access to the infringing material. Since we do not host files, our block will prevent our API and edge proxy from resolving or processing the specified SoundCloud URL(s) on our website, effectively disabling the download feature for those specific tracks.

6. Counter-Notification Process

If your URL was blocked on our site as a result of a DMCA takedown notice, and you believe this was due to a mistake or misidentification (for example, you own the rights to the track or have Creative Commons authorization), you may submit a Counter-Notification to our Designated Agent.

A valid Counter-Notification must be a written communication that includes:

  • Your physical or electronic signature.
  • Identification of the URL that has been blocked and the location at which the material appeared before access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, physical address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to the jurisdiction of the Federal District Court in San Francisco, California), and that you will accept service of process from the person who provided the original DMCA notice or their agent.

7. Warning Against False Notifications (17 U.S.C. § 512(f))

WARNING: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be held liable for damages, including legal costs and attorney\'s fees, incurred by the alleged infringer, by the copyright owner, or by our Service.

8. Repeat Infringer Policy

Because our Service is stateless, does not have user accounts, profiles, or registration databases, we do not have a standard mechanism to track repeat user identities. However, we log blocked infringing URLs. If a third-party SoundCloud URL is repeatedly reported for copyright violations, we will blacklist that URL permanently from being processed by our converter.
